The town hall follows a recent ruling by the Texas Business Court, which granted Neugebauer’s emergency motion for expedited discovery. This legal development marks a significant hurdle for the incumbent board, which Neugebauer accuses of suppressing shareholder rights and mismanaging liquidity through court-prolonged disputes. He has publicly advocated for a banker-led strategic review to maximize value, a proposal the board has resisted while imposing a 70% supermajority requirement for electing new directors.

While Neugebauer initially invited Governor Rick Perry and Griffin Perry to discuss the company's future, they have yet to accept. In an effort to ensure balanced representation, Neugebauer has extended an invitation to Fermi Co-President and COO Jacobo Ortiz to join the session. Regardless of their attendance, Neugebauer intends to field unscripted questions from analysts to provide transparency regarding the company’s current governance and operational status.
