Fluence Energy Faces Class Action Over Production Remediation Claims

Investors have launched a securities class action against Fluence Energy, alleging the company misled shareholders regarding the effectiveness of its manufacturing fixes. The lawsuit claims that despite management’s assurances of successful remediation, persistent production failures at contract facilities spread to new sites, resulting in significant stock price volatility.

Fluence Energy Faces Class Action Over Production Remediation Claims

The legal action, filed in the U.S. District Court for the Southern District of New York, covers the period from November 24, 2025, through September 16, 2026. According to the complaint, Fluence Energy repeatedly touted corrective measures for its contract manufacturers in Arizona and elsewhere, even as production delays mounted. By August 2026, the company announced that $400 million in project deliveries would be deferred to the following fiscal year, citing ongoing difficulties at both domestic and international facilities.

Financial performance suffered alongside these operational hurdles. The company’s fiscal 2026 adjusted EBITDA outlook shifted from a $50 million profit midpoint to a projected loss of $200 million. Furthermore, adjusted gross profit margins narrowed to approximately 5.9% in the June 2026 quarter, down from 15.4% the previous year. Shares of FLNC saw sharp declines following a series of disclosures on February 5, August 6, and September 17, 2026. Investors seeking to participate in the lead plaintiff process must apply by November 27, 2026.
