According to the complaint filed by The Button Law Firm, the substitute teacher grabbed the boy, shook him, and swept his legs out from under him, causing him to crash onto the hardwood floor. The suit alleges the teacher then instructed another student—her own son—to hit and kick the child while the primary classroom teacher observed without intervening. Following the event, the boy suffered physical injuries including bruises and scratches, alongside lingering anxiety and post-traumatic headaches.

A subsequent investigation by the Texas Health and Human Services Commission substantiated these claims, citing the facility for improper disciplinary methods and failure to protect children. Records show that Arka Montessori has accumulated 16 safety violations since its 2024 opening. Attorney Russell Button, representing the Harris family, noted that the state's findings mirror the disturbing footage, underscoring a systemic failure to provide a safe environment. The lawsuit, currently pending in Tarrant County, seeks to hold the center accountable for what the family describes as a environment akin to a child fight club.
