The lawsuit, filed in the U.S. District Court for the Northern District of California, centers on a window between May 19 and July 16, 2026. During this period, management repeatedly assured the market that the Gemini 3.5 Pro model would debut in June. However, a July 16 Bloomberg report revealed the project was months behind schedule, noting that recent training data updates had yielded disappointing results. Following this disclosure, Alphabet’s Class A and Class C shares dropped approximately 4.4%.
Plaintiffs contend that Alphabet failed to disclose these technical setbacks, rendering their public growth projections misleading. While Alphabet later confirmed the model was in testing during a July 22 earnings call, it offered no specific release date, and subsequent reports indicated the company eventually abandoned plans for the 3.5 Pro release entirely. The litigation, led by Levi & Korsinsky, LLP, seeks recovery for investors who purchased securities at what they claim were artificially inflated prices during the class period.
