The firm has initiated two legal applications under 28 U.S.C. § 1782 to compel the production of internal documents from Cognizant Technology Solutions Corp. and The Carlyle Group Inc. These filings, lodged in Delaware under case numbers 1:26-cv-00924-CFC and 1:26-cv-00719-CFC, aim to secure evidence for use in German courts. Petrus clarified that it does not view these companies as adversaries, but rather as custodians of information critical to the valuation dispute. By pursuing these discovery requests, the firm signals its intent to challenge the assumptions currently driving sell-side optimism regarding the KPMG Financial Factbook and its influence on future judicial outcomes.
