The litigation, titled Velanki v. Hims & Hers Health, Inc. et al., stems from an FTC enforcement action announced on July 29, 2026. Regulators allege that the company shared sensitive medical data with third-party advertising platforms while simultaneously claiming to maintain strict user privacy. Further accusations involve deceptive billing, specifically that the firm charged for prescriptions immediately after an intake form submission, contradicting promises that users would consult with medical providers to determine appropriate treatments first.

Following the FTC disclosure, shares of Hims & Hers fell by $4.32, closing at $25.00 amid heavy trading volume. The law firm Kahn Swick & Foti, LLC, led by former Louisiana Attorney General Charles C. Foti, Jr., is currently representing investors who suffered losses during the class period of August 4, 2025, to July 29, 2026. Those seeking to serve as lead plaintiffs have until November 2, 2026, to file their petitions with the court.
