The settlement, overseen by Judge Eumi K. Lee, addresses allegations made by lead plaintiff Anthony Joseph Peters against the company and executives Emily M. Leproust and James M. Thorburn. The case, filed as Case No. 5:22-cv-08168-EKL, concerns individuals who acquired common stock during the December 2020 offering or held shares throughout the period spanning December 20, 2018, to November 15, 2022.

A final approval hearing is scheduled for November 18, 2026, at the Robert F. Peckham Federal Building in San Jose. During this proceeding, the court will evaluate the fairness of the payout, legal fee applications, and the proposed distribution plan. Eligible shareholders must submit a valid proof of claim form by November 17, 2026, to participate in the settlement fund. Those seeking to opt out of the class or file formal objections to the terms must submit their requests by October 7, 2026.
