The complaint alleges that between February 2024 and February 2026, Procept executives misled the market regarding the true adoption rate of its AquaBeam Robotic Systems. Plaintiffs contend that while the company touted strong utilization trends, it was simultaneously building excess field inventory through an undisclosed discount program. This discrepancy between reported sales and actual surgical procedures allegedly collapsed when the true inventory levels were eventually revealed.
Shiblaq, who served as Chief Commercial Officer until September 2025, is accused of overseeing the commercial operations at the heart of these disclosures. The legal action, filed in the U.S. District Court for the Northern District of California, asserts violations of the Securities Exchange Act. Law firm Levi & Korsinsky is currently seeking lead plaintiffs for the case, setting a September 22, 2026, deadline for those who suffered losses to come forward.
