The investigation focuses on the Illinois Bivens Act and the Illinois Court Access, Safety, and Participation Act. These measures allow individuals to sue federal immigration officers, potentially subjecting them to punitive damages based on tactical choices like body-camera usage or vehicle identification. The NPA is demanding drafts, emails, and memoranda from the offices of Governor J.B. Pritzker, Attorney General Kwame Raoul, and the Illinois Senate.

NPA President Eddie Hutchison argues that these statutes represent a targeted effort to make federal law enforcement financially ruinous. Beyond the liability risks, the laws impose a $10,000 statutory penalty on arrests made near state courthouses. The organization now seeks to uncover whether state politicians coordinated with anti-law enforcement groups to craft these provisions, effectively using the judicial system to challenge federal immigration mandates.
