The lawsuit, filed in the United States District Court for the Northern District of California under the caption Velanki v. Hims & Hers Health, Inc., centers on claims that the firm failed to disclose the sharing of consumer health information with third-party advertising platforms, including Meta and Snap. Furthermore, the complaint alleges the company charged users for prescriptions before they could consult with medical providers, despite marketing claims suggesting a personalized treatment selection process.

Regulatory scrutiny intensified on July 29, 2026, when the Federal Trade Commission initiated its own action against the company, citing deceptive privacy practices. Following the revelation, Hims & Hers stock fell by $4.32, or 14.73%, to close at $25.00 per share. Investors wishing to participate as lead plaintiff in the class action must file their applications by November 2, 2026.
