Pleasants Power Station Bankruptcy Faces Six Formal Objections

Six formal objections have been lodged against the Chapter 11 proceedings for the 1,278-megawatt Pleasants Power Station, setting up a contentious showdown in a Wilmington courtroom. U.S. Bankruptcy Judge Karen B. Owens is scheduled to weigh these competing interests during a pivotal hearing set for September 3 in Delaware.

The legal pushback comes from Omnis Fuel Technologies, Quantum Pleasants, the West Virginia Economic Development Authority, and the U.S. Trustee. At issue is the debtor's request to use cash collateral, finalize bidding procedures for a plant sale, and appoint Herbert Smith Freehills Kramer as bankruptcy counsel. Omnis and Quantum specifically challenge the security of lender obligations held by TRAG LLC and RG Energy, entities linked to Tony Robbins and Ajay Gupta.

Beyond ownership disputes, the West Virginia Economic Development Authority—which holds a claim exceeding $50 million—argues that proposed lender protections are overreaching and risk chilling potential bids. Simultaneously, the U.S. Trustee has questioned the adequacy of HSF Kramer’s disclosures regarding its prior representation of the lenders. With a separate motion to dismiss the bankruptcy still pending for later this year, the September 3 ruling will determine the immediate direction of the plant's restructuring and the operational control of the facility.
