Allegations of fraudulent billing and unsafe medical practices have triggered a formal investigation into TransMedics Group, Inc. by the law firm Kahn Swick & Foti. The inquiry centers on whether the company’s officers and directors breached their fiduciary duties following a series of damning claims regarding the firm’s organ transplant operations.

The investigation follows a January 10 report from Scorpion Capital, which leveled serious accusations against the medical technology company. Drawing on 30 interviews with former employees, surgeons, and industry stakeholders, the report alleged that TransMedics engaged in coercive business practices, extortion, and systemic fraud under the pretense of its Organ Care System operations. These claims have already sparked a separate, ongoing securities class action lawsuit against the company and its executive leadership for allegedly failing to disclose material information to shareholders.

Kahn Swick & Foti, led by former Louisiana Attorney General Charles C. Foti, Jr., is now scrutinizing the company's internal governance to determine if federal or state laws were violated. The firm is inviting long-term shareholders and individuals with relevant information to contact their legal team as they assess potential breaches of fiduciary duty.
