California Advances Legislative Package to Curb Insurance Abuses

Seventy percent of Los Angeles fire survivors report that insurance delays and underpayments have crippled their recovery efforts, fueling a push for new oversight. Three legislative bills aimed at curbing abrupt nonrenewals and forcing timely disaster payouts cleared the Assembly Appropriations committee today, moving toward a final floor vote.

The legislative package, championed by the Every Fire Survivor's Network and Consumer Watchdog, targets two systemic failures: the mass exodus of homeowners from the private market and the chronic underpayment of claims after wildfires. Senator Ben Allen’s SB 1301 seeks to stabilize the market by prohibiting insurers from dropping policies based solely on roof age or the filing of certain claims. It also mandates that companies provide specific justifications for nonrenewals, granting homeowners a window to perform repairs and maintain coverage.

Senator Sasha Renée Pérez authored the remaining two measures to address the "useless" nature of current policies during disasters. SB 878 imposes strict timelines on insurers, requiring partial payments within 30 days for total losses and penalizing late payments on undisputed claims. Complementing this, SB 877 mandates that insurance companies disclose all original loss estimates and subsequent revisions, preventing firms from hiding data during disputes. These reforms arrive as nearly one million Californians have been forced into the state’s high-cost, low-benefit FAIR Plan, a trend advocates say has left working families financially exposed when they are most vulnerable.
