The class action, spanning the period from November 25, 2025, to May 4, 2026, alleges that Embecta repeatedly characterized its pen needle portfolio as resilient and stable. Plaintiffs claim these assurances masked underlying issues, including significant competitive share loss and retail market softness that executives allegedly ignored while maintaining positive financial guidance.
The discrepancy came to light on May 5, 2026, when Embecta reported a steep revenue decline and slashed its fiscal 2026 adjusted EPS guidance by 43%. The company also cut its quarterly dividend from $0.15 to $0.01 per share. These revelations triggered a 57.8% drop in the company's stock price in a single trading day.
Reed Kathrein, a partner at the law firm Hagens Berman, is spearheading the investigation into whether these prior executive statements were intentionally misleading. Shareholders who held stock during the class period have until August 17, 2026, to file as lead plaintiffs. The firm is also seeking whistleblowers with non-public information regarding the company's internal operations.
