Reed Kathrein, a partner at Hagens Berman, stated that the firm is working to determine exactly when management became aware that their expansion model was actively shifting traffic away from established locations. The complaint further alleges a failure of internal controls, noting that the company did not disclose these financial headwinds until the May 12, 2026, earnings report. Beyond the class action, the firm is encouraging whistleblowers with non-public information to come forward, citing potential SEC reward programs for original evidence.
