The lawsuit, filed by Hagens Berman Sobol Shapiro LLP, targets the period between February 28, 2024, and February 25, 2026. Plaintiffs allege the company incentivized customers to order inventory far exceeding their actual procedural needs, effectively pulling revenue forward from future quarters. This strategy eventually collapsed, resulting in a reported surplus of over 10,000 handpieces in customer inventories.
The market began to react in August 2025, when the company reported quarterly results that fell well below analyst expectations. Subsequent disclosures in late 2025 and early 2026 confirmed that U.S. handpiece sales had consistently outpaced actual medical procedures. By February 25, 2026, the company’s share price had fallen by more than 48% relative to its August 2025 closing price. During the final disclosure, management admitted to eliminating the bulk discount program and acknowledged a sequential 30% cratering in U.S. handpiece sales.
Reed Kathrein, the partner leading the investigation, stated the firm is examining whether the company intentionally obscured its sales mechanics to maintain the appearance of growth. Investors who suffered losses have until September 22, 2026, to file for lead plaintiff status. The firm is also soliciting information from potential whistleblowers who may provide additional insight into these sales practices.
